Museveni Issues Executive Order to Simplify National ID, Passport Issuance

President Yoweri Kaguta Museveni has issued an Executive Order to simplify the process of issuing identification documents to Ugandan citizens.

The directive, made under Article 99 (1) and (4) of the 1995 Constitution, addresses long-standing complaints about delays and inefficiencies in the immigration system.

Key Highlights of the Directive

1. Right to Identification: Every Ugandan citizen has the right to a passport or other travel documents, as well as the right to enter, leave, and return to Uganda.

2. Simplified Application Process: Passport applicants need only provide their National Identification Number (NIN) and comply with other legally published requirements, as per Section 40 of the Citizenship and Immigration Control Act, Cap. 313.

3. Presumption of Citizenship: Immigration officials must presume citizenship by birth unless they have credible evidence to the contrary. The burden of proof lies with the officer, not the applicant.

4. Referral to NIRA: Questions about an applicant’s citizenship claims should be referred to the National Identification and Registration Authority (NIRA) for verification.

5. Acceptable Documents: Birth certificates, voter’s cards, driving permits, and baptism certificates are acceptable for NIRA registration. If unavailable, a relative can identify the applicant under oath via a statutory declaration.

6. Equal Treatment: All applicants must be treated equally, regardless of tribe, ethnicity, or community.

7. Role of Local Authorities: Applications supported by letters from local authorities and corroborated by notable elders should be processed promptly.

8. Citizenship for Children: The Minister of Internal Affairs and the Attorney General are directed to address anomalies regarding automatic citizenship for children of citizens by birth or naturalization.

“The legal framework for citizenship is clear, but administrative processes have been problematic. This order ensures that every Ugandan’s rights are protected,” President Museveni stated.
